Are you 100% sure the image is free to use in osm? Even it’s possible to use it as a background image.

Moreover, there is an option to select aerials from Läntmateriet in iD editor, it just does not work due to API update.

FB and Telegram are not the Swedish national authority (Lantmäteriet).

No, the above link is not valid for “Min karta”. “Terrängkartan” (and some others) are open data, but in general the aerial imagery in “Min karta” is not open data and you cannot use it for Openstreetmap editing.

Hmmm. For now I stop using thise aerial imagery, we need to come to a conclusion here: on the very link you sent earlier:
Looks like OSM is an example of a non-profit organization.

Yes, OSM is a non-profit organization, but we do not simply publish the information on “my map”, we convert it into information that is shared using the ODBL-license, which in turn means that anyone, including for-profit companies, can use the data as they see fit.
To be sure, I recommend raising this question on the Swedish OSM maillist or the Swedish OSM Facebook group, so that others that are more experienced in these issues may help us.

Hi NKA,
Let me clarify this. The reply from Lantmäteriet means that we are allowed to use their imagery as a custom source in our editor for mapping purposes, but in case we want to add them as a named layer to editors, we need to pay money to them. And that’s the reason why we now don’t have it there among other imagery sources.
Am I right?

To clarify:
We are allowed to trace/to map based on what we see in the orthophotos from Lantmäteriet, for example on Min Karta. So the orthos are an acceptable source for OSM.
We do not have the permission to use the WMS service unless we pay for it. This is why the WMS has not been included in the predefined imageries for JOSM and iD.
Private use of the WMS in editors is perhaps a grey area, since we are permitted to view the content of the same WMS in Min Karta/in browsers, but I do not think this is something Lantmäteriet would endorse.

In my point of view, the problem here isn’t really Lantmäteriet, but the contributor terms of OpenStreeMap that clearly states that you, as a contributor, must ensure you have the right to license your uploaded data as ODbL. Personally, I can not assure that. Lantmäteriet has not given any such permission regarding the recent aerial photos. Historic Orthophotos, on the other hand, are released under CC0 and therefore ODbL compatible.
